Special Damages

Claim compensation for your financial loss caused by an accident

“Special damages” is the legal term used for the compensation that is paid for the financial losses and expenses caused by the accident. The following are some of the more common examples of what can be claimed, and the documentary evidence you are likely to need to prove the losses:-

Example Documents
Loss of Earnings - past and future e.g. payslips before and after the accident/P60/P45, business records.
Damage to career prospects or inability to do certain types of jobs e.g. Career information
Unpaid care and assistance from family and friends while you are injured Records of dates and time spent caring for and assisting you and what work was done
Cost of professional nursing care Invoices/receipts
Travelling expenses (to hospital, doctors, physiotherapist etc.) By car: a record of the date, mileage and purpose of each journey
By bus/train: Ticket and purpose of each journey
Cost of gardening Receipts
Cost of prescriptions or other medical equipment Receipts
Cost of medical, physiotherapy, chiropractic or osteopathy treatment Receipts

 

There may be other things which you can claim for. We can advise you fully on this during your case. However, it is recommended that from the very beginning you keep a careful record of your expenses and all documents (e.g. receipts, invoices) to prove your losses to the other side.
